Warranty Commencement and Extension Clause Warranty Commencement: The warranty period for all materials and workmanship shall commence upon Substantial Completion of the swimming pool project, defined as the date when the pool is fully operational and capable of use, regardless of whether the homeowner has taken possession of the property. Occupancy Extension: Because the homeowner’s residence is still under construction, Staycation Creation Pools & Spas agrees to extend the start of the standard warranty period. The warranty will officially begin on the earlier of: The homeowner’s occupancy of the residence, or Ninety (120) days after Substantial Completion of the pool, whichever occurs first. Pre-Occupancy Conditions: To maintain warranty eligibility during the period between pool completion and occupancy, the following conditions must be met: The pool must remain properly maintained, chemically balanced, and protected from damage. Staycation Creation Pools & Spas will not be responsible for any damage or malfunction caused by neglect, improper chemical balance, third-party activity, or unrelated home construction work. Effect of Extension: This clause ensures the homeowner receives the full benefit of the standard warranty period beginning upon occupancy, without losing coverage for workmanship or equipment installed prior to that date. |
